Daily & Weekly Equipment Rental Agreement

1. Rental Equipment Payment: All advance orders must be paid in full at time of order. No orders will be delivered if there is an unpaid balance and availability will not be guaranteed. We recommend making any additions to your equipment order prior to check-in to guarantee availability. Pricing and equipment availability is not guaranteed until you receive a return confirmation. We accept cash, Visa, MasterCard & Discover. We require a credit card number as a security deposit on all orders.
    

2. Refunds: No refunds will be given once delivery has been made. Refunds will not be made due to inclement weather or hurricane evacuation.
    

3. Satisfaction: We guarantee your satisfaction. Upon delivery, we cannot offer refunds, but we will gladly make exchanges for items of comparable value on a one-time basis if available. To exchange an item please contact us, and we will deliver your new rental item.
    

4. Cleanliness: All items are cleaned and checked prior to delivery. Please leave all items clean.
    

5. Beach/Baby Equipment: Bicycles, beach chairs, umbrellas and other outdoor beach equipment should never be left on the beach unattended or overnight. Tim’s Beach Gear staff shall do ALL crib assembly.
    

6. Lost or Damaged Equipment: All equipment is thoroughly cleaned and checked prior to delivery. Upon arrival, inspect all items and call us immediately to report any discrepancies. Otherwise, Lessee will be charged for repair or replacement of items. Lessee is responsible for any damage or theft to equipment, should any occur. Your credit card will be charged replacement value for the item.
    

7. Hold Harmless/Release of Liability: Lessee assumes all responsibility for equipment while in his possession and agrees to return it in the same condition. Lessee shall be liable for any loss, theft, destruction or damage of said leased rental equipment. Lessee agrees to pay for the regular replacement cost of items lost or damaged beyond repair. Lessee should inspect cribs, high chairs or any other gear for safety prior to use. In consideration of the rental agreement between Lessee and TIM’S BEACH GEAR, LLC, Lessee acknowledges and agrees to the following terms: Lessee understands that there exist certain risks of injury from the use or misuse of such items, including the potential risk of serious injury, disability or death from the use of such items. Lessee knowingly and freely assumes all such risks, both known and unknown, and assumes full responsibility for the use of such items. Lessee understands the risks associated with the use of such items and understands the safety concerns regarding the items. Lessee agrees for themselves and on behalf of their heirs, assigns, personal representatives and next of kin to release, hold harmless and agree not to sue TIM’S BEACH GEAR, LLC, the lessor of all such items lessee has agreed to rent, their officers, agents and employees, with respect to any and all injury, disability, death, loss or damage to person or property, whether caused by the negligence of the lessor or otherwise, except that which is the result of gross negligence or wanton misconduct. Lessee understands that this release of liability covers each and every item which lessee has agreed to rent. Lessee further agrees that this release of liability shall be governed by the laws of the State of Georgia. Lessee has read and understands this release of liability and fully understands its terms and fully understands they have given up substantial rights by signing the Equipment Order Form and sign it freely and voluntarily without inducement.
    

8. All Items Reserved: All items will be delivered to your vacation home per the agreed-upon time.
    

9. Check-Out: A time will be arranged to pick up all items prior to your departure.
    

10. Delivery & Pick-Up: Delivery and pick-up is FREE.
     

11. Bicycle Rental: TIM’S BEACH GEAR, LLC will provide (1) approved helmet with each bike or “tug-a-bug” rental. Georgia state law prohibits anyone under the age of 16 to ride a bicycle without an approved helmet. It also prohibits any child under the age of 4 to ride on a “tug-a-bug”. Georgia state bicycle law 40-6-290 thru 40-6-299 is applicable on all bicycle rentals. TIM’S BEACH GEAR, LLC and its employees reserve the right to approve or deny all bicycle rentals.
